Job Description and Duties

Under general direction of the Chief Counsel, the Deputy Chief Counsel, or the Assistant Chief Counsels, the Attorney III represents the Department of State Hospitals (DSH) in court proceedings, at forensic and State Personnel Board (SPB) proceedings, and provides legal advice to DSH on the more difficult and sensitive issues involving the administration of all DSH facilities. The Attorney III must operate with broad discretion and with minimal direction towards achieving DSH’s objectives.

Performs legal research and provides legal advice to DSH clients on broad and specialized areas of law within a difficult or sensitive program. Responds to questions about mental health funding and fiscal controls. Provides responses to the Governor's Office, the Health and Human Services Agency and State control departments. Provides legal expertise on various DSH programs which may involve unsettled points of law or rapid evolving areas of law, regarding but not limited to, legislation, regulations, DSH policy, Public Records Act requests, and subpoenas. Work involves contract negotiations, drafting and reviewing contracts, and employee immigration law. Performs legal research and provides legal advice on complex issues involving, but not limited to, patient privacy, employee privacy, intellectual property, potential conflicts of interest, Cal OSHA audits, risk management, data sharing, and advice on departmental contracts. Travel may be required as a part of these specified duties.
